Riddler Rules and Riddler Terms & Conditions of Use ("TCUs")
RIDDLER TERMS AND CONDITIONS OF USE
1. Introduction and Definitions
IF YOU DO NOT WISH TO BE BOUND BY THESE TCUs, PLEASE DO NOT
REGISTER FOR OR USE RIDDLER. YOU MUST BE AT LEAST 18 YEARS OF AGE TO REGISTER OR USE RIDDLER.
We may at any time, with or without cause, and without notice or liability to
Members, change, eliminate, or restrict the use of all or any portion of Riddler
(including, without limitation, any Riddler games or the Member area), including limiting the time
of Riddler availability, the amount of use permitted, or the Members who are permitted to use it.
By using this site and the Riddler games, you signify your assent to these terms and conditions.
If you do not agree to these terms and conditions, please do not use Riddler.
2. Riddler Rules
The Riddler Rules contain important information about registration requirements, game rewards and
limitations. The Riddler Rules, as modified from time to time by the Company, are incorporated in
these TCUs by reference and constitute an integral part of these TCUs. To read the current Riddler
Rules at any time, click on the Rules and Terms link on the Riddler Games Page.
Upon completion of registration and acceptance of thses TCUs, you will select a unique User Name
and Password. All subsequent use of Riddler may require the entry of such User Name and Password
to gain access to the Riddler members' features. You are responsible for all use of Riddler under
the User Name and Password you
select, regardless of who may actually be using them. It is a violation of these
TCUs for any Member to allow another person to use his or her User Name and
Password to access Riddler, or for any person to solicit or use another Member's
User Name and Password, or for any Member to have more than one Riddler
account.
You represent and warrant that all personal information provided by you is accurate to the best of
your knowledge at the time of providing the information. Intentionally providing inaccurate or
misleading information will constitute a violation of these TCUs.
3. Communicating With Other Members on Riddler
As a part of some of the games on Riddler, Members are permitted to communicate with
other Members in "chat" and "forum" areas. By accepting these TCUs, you agree not to use
Riddler to:

send, or submit for public posting, any abusive, obscene, profane,
sexually explicit, threatening, harassing or illegal material; or

engage in advertising to, or solicitation of, other Members to buy or sell any products or services. In the event any such activity is detected by Company,
We may at any time without notice suspend or terminate any Member's use of Riddler. In
addition, we reserve the right to monitor chat and forum areas at all times, and we may refuse to display, or
may remove from display, any material that we believe, in its our judgment,
violates these TCUs, the Riddler Rules, or any other policies or guidelines posted
on Riddler.
BY SUBMITTING MATERIAL TO A "CHAT" OR "FORUM" AREA FOR POSTING, YOU AGREE
TO INDEMNIFY COMPANY, ITS OFFICERS, DIRECTORS AND EMPLOYEES,
AND HOLD THEM HARMLESS FROM ALL CLAIMS, INCLUDING, WITHOUT
LIMITATION, CLAIMS FOR LIBEL OR SLANDER, ARISING FROM THE
SUBMISSION. Each Member is solely responsible for all submissions from the account
using his or her unique User Name and Password.
The Company does not endorse, assert or stand behind the truthfulness or reliability of
opinions, advice or statements given or made on Riddler by anyone other than
authorized Company spokespersons.
4. Prizes
Member Prize Eligibility: Members of Riddler who are not legal residents of the United
States of America or Canada may register and play Riddler games; but, such Members ARE NOT ELIGIBLE to claim
and receive prizes offered on Riddler. All Members should carefully read Section 7 of these TCUs
with regard to tax issues affecting prize claims by Members, as all Members are responsible for any tax implications
resulting from prize claims.
Prizes are provided by and through Riddler Riddler prizes are made available to be claimed in
quantities and at intervals determined by us. When you have claimed a Riddler prize (which prize
is subject to the Company's verification and audit of the competition for such prize), you must
provide the Company with your name, address, e-mail address, date of contest that you have won,
telephone number, social security number and other information required for tax notification
purposes or for delivery of the prize. This information may be made available to tax authorities.
We will also require winners of prizes valued at $100 or more to sign an Affidavit of Prize
Eligibility and a Liability and Publicity Release. Both documents must be signed, notarized and
returned for receipt by us no later than 21 days from the date on the letter accompanying the
documents. Failure to return properly notarized documents prior to the return deadline may result
in the forfeiture of the prize.
Riddler games are for humans, not machines. Riddler games are meant to be
played in a linear fashion from start to finish, one at a time, using a single
computer, Internet connection and Web browser window. The use of scripts or any
other automated system to play Riddler games is strictly prohibited. Members are
similarly restricted from playing Riddler games with more than one type, version or
copy of a browsing application at any one time. "Queuing" or otherwise starting
multiple overlapping games and then completing them in succession, by whatever
technique, is strictly prohibited.
Should we any determine, in its sole discretion, that any Member has violated
any of the prohibitions contained in these TCUs, we shall have no obligation
to award any prizes won by such Members. We reserve the right to audit all
online game interactions, and the award of any prize is subject to the findings of
such audit. In addition, we reserve the right to seek any other form of relief,
including damages, injunctive relief and attorneys' fees with respect to any
fraudulent or other illegal activity in connection with entry or participation on Riddler, in the
Riddler games, or activity in contravention of the Riddler Rules or the Riddler
Terms and Conditions of Use.
5. Taxes
You may be required to report as taxable income the value of any prizes received
by you. To collect a prize, you will be required to provide a valid Social Security or
other tax identification number and the information listed in Section 6 of the TCUs.
We and/or the Riddler sponsor who provides a particular prize may report
the value of the prize to Federal and/or state taxing authorities.
6. Termination
Either you or the Company may terminate your Riddler Membership at any time and
without cause. Your sole right with respect to dissatisfaction with any policies,
guidelines or practices of the Company in operating Riddler, or any change in Riddler
content, is for you to terminate your Riddler Membership.
We may terminate or temporarily suspend any Member's access to all or any
part of Riddler, without notice, for conduct that we believe is a violation of
these TCUs or any policies or guidelines posted by the Company on Riddler, or for
other conduct that we believe, in its our sole discretion, is harmful to
us, other Members or to the interests of Riddler sponsors. Once a
Membership has been cancelled for cause under this paragraph, we
reserve the right to deny re-registration of that individual as a Riddler Member.
7. Member Information
As a Riddler Member, you consent to receive communications from the Company or its affiliates and
from other well-established entities selected by the Company. Communications from the Company
update and advise Riddler Members of new games, events, services and benefits of Riddler Membership.
Communications from entities selected by the Company may contain information and often valuable
and exclusive coupons, samples and other exciting offers. As a Riddler Member, you have the right
to choose not to receive these exciting and valuable communications from entities selected by the
Company simply by sending an email with your Riddler user name, and registered e-mail to
help@riddler.com with "Unsubscribe from
Riddler mailing List" in the body of the email.
Members' Privacy Information: Below is a summary of our privacy policy, please

We will never give out any information linking your real name to your screen name unless you
authorize us to do so, or unless required to do so by law. We may, however, give your address
to a third party for the specific purpose of prize fulfillment or promotions.

Advertisers and other partners do not receive any specific personal information. We only provides
our advertisers and other partners with aggregate information (mass information used to show
trends and patterns) about the people using our site.

We will divulge your private information if required to do so by law. If served with a subpoena,
search warrant, or court order, we would provide the necessary information.

We do track certain general usage pattern information. We track information including what games
people play, how long they have been Riddler members and if they have won prizes.
This information is used in aggregate form to improve www.riddler.com site and is provided
(also in aggregate form) to advertisers and partners. On the registration page, we require
members to fill in certain Member information ("Member Information") including month/year of
birth, zip code, e-mail address, gender and country. We require the Member to choose a
screen name and password. An activated member can also change their account info in the My
Riddler (Member's Area) portion of the site. With targeted advertising, we deliver
advertising messages to the types of audience our advertisers most want to reach. We
use the Member Information that our Members provide to assist in the identification of
Members who meet these criteria. However, our advertisers are not provided with access
to Members' personal information.

We do occasionally use your registration information to target advertisements to you.
This is done to customize your Riddler experience and provide you with the most appropriate
advertisements. The actual targeting is done via our ad server and your personal information
is not seen by the advertiser.

We have security measures in place to protect the loss, misuse and alteration of the
information under our control. The servers for our site are stored in a physically secured and
climate controlled off-site facility. Beyond the physical protection of the servers, we
protect against data loss by regularly backing up data, performing consistency checks with
independently recorded log files to prevent tampering, and restricting access to information
on our servers via several user authentication technologies.
Members are solely responsible for maintaining the secrecy of their usernames, passwords and /or
any other account information.

You do not have to be sent Riddler updates and newsletters.If at any time you wish to
discontinue receiving the Riddler newsletter, simply click the link at the bottom of the
newsletter to unsubscribe.

You can unregister from Riddler at any time. If for some reason you no longer want to be a
registered Riddler member, please e-mail
help@riddler.com in order to insure that you are
completely removed.
8. TRADEMARKS, COPYRIGHTS AND PROPRIETARY RIGHTS
Riddler maintains the Riddler web site for your personal entertainment, information, education,
and communication purposes. You may not distribute, modify, transmit, reuse, re-post, or use the
content of the web site for public or commercial purposes, including the text, images, audio and
video without Riddler's written permission.
You should assume that everything you see or read on the site is copyrighted unless otherwise noted
and may not be used except as provided in these TCUs or in the text on the site without the written
permission of Riddler.We neither warrant nor represent that your use of materials displayed on
the site will not infringe rights of third parties.
While we use reasonable efforts to include accurate and up-to-date information in the Site, we
make no warranties or representations as to its accuracy. We assume no liability or responsibility
for any errors or omissions in the content of the site.
Your use of and browsing in the site are at your risk.Neither Riddler nor any other party
involved in creating, producing or delivering the site is liable for any direct, incidental,
consequential, indirect or punitive damages arising out of your access to, or use of, the site.
Without limiting the foregoing, everything on the Site is provided to you "AS IS" WITHOUT WARRANTY
OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Any communication or material you transmit to the Site by electronic mail or otherwise, including
any data, questions, comments, suggestions, or the like is, and will be treated as, nonconfidential
and non-proprietary. Anything you transmit or post may be used by Riddler or its affiliates for any
purpose, including, but not limited to, reproduction, disclosure, transmission, publication,
broadcast and posting. Furthermore, the Company is free to use any ideas, concepts, know-how or
techniques contained in any communication you send to the site for any purpose whatsoever including,
but not limited to, developing, manufacturing and marketing products using such information,
without any additional compensation to the Member.
The trademarks, logos, and service marks (collectively the "Trademarks") displayed on the site,
including the names of all games and puzzles, are registered and unregistered Trademarks of the
Company and/or others. Nothing contained on the site should be construed as granting, by
implication, estoppel or otherwise, any license or right to use any Trademark displayed on
the site without the written permission of the Company or such third party that may own the
Trademarks displayed on the site. Your misuse of the Trademarks displayed on the site, or
ny other content on the site, except as provided in these TCUs, is strictly prohibited.
9 DISCLAIMER OF WARRANTIES; LIMITATIONS OF LIABILITY
RIDDLER IS PROVIDED TO MEMBERS ON AN "AS IS" BASIS, AND NO
WARRANTIES ARE MADE BY COMPANY REGARDING RIDDLER OR ANY
SERVICES OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH
A MEMBER'S USE OF RIDDLER, AND COMPANY HEREBY EXPRESSLY
DISCLAIMS ALL WARRANTIES WITH RESPECT TO RIDDLER, INCLUDING
WITHOUT LIMITATION: (1) ANY WARRANTIES AS TO AVAILABILITY,
ACCURACY, OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES;
AND (2) ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE.
THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES,
AGENTS OR CONTRACTORS, SHALL NOT BE LIABLE, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION, INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR DAMAGES CAUSED OR ALLEGEDLY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATIONS UNAUTHORIZED ACCESS TO, OR THEFT, DESTRUCTION, ALTERATION, OR USE OF, RECORDS.
10. Miscellaneous
These TCUs, the Riddler Rules, the Riddler Privacy Policy and all policies and guidelines posted on Riddler, which you accept by registering as a Member of Riddler, contain the entire agreement ("Agreement") between you and Company regarding all aspects of your
use of Riddler, and may be amended at any time by the posting of revisions on Riddler. The Agreement shall be governed by and interpreted under the laws of the State of New York, without regard to its conflict of law rules.
We do not represent or endorse the accuracy or reliability of any of the information, content or advertisements (collectively, the "Materials") contained on, distributed through, or linked, downloaded or accessed from any of the games or services contained on this site (the "Service"), nor the quality of any products, information or other materials displayed, awarded, or obtained by you as a result of a drawing, an advertisement or any other information or offer in, or in connection with, the Service (the "Products"). You acknowledge that any reliance upon any Materials shall be at your sole risk.
The Member acknowledges that if any provision of this Agreement conflicts with any other rule, regulation, term or condition of the site, the terms and conditions of this Agreement shall govern.
RIDDLER RULES
I. Object of Riddler
The object of Riddler games is to have fun! You can also win prizes if you are registered, in our
contests.
II. Registration

New players must register before winning prizes or gaining access to any members' areas/features
that may exist.

No player may have more than one Riddler account.

Click on the "Sign Up" link on the home page and fill in the online registration form. Incomplete
registrations cannot be accepted. You will also be required to accept the Terms and Conditions of
Use and Riddler Privacy Policy in order to be eligible to participate in Riddler. You should read
the TERMS AND CONDITIONS OF USE carefullybecause they constitute the legal agreement under which
you will participate in Riddler and contain important information and limitations concerning
Riddler games.
